These Terms&Conditions shall apply between:
"RODINOVI" EOOD, UIC 204713743, with registered office and management address: Village of Strashimirovo 2 Ivan Vazov St, 9179, Republic of Bulgaria, hereinafter referred to as the VENDOR, on the one hand, and on the other hand, the person who has agreed to these "Terms&Conditions", hereinafter referred to as the USER, in connection with the use of the website www.hotfarm.eu
Please familiarize yourself with these terms and conditions of use of the website and online store www.hotfarm.eu. These terms and conditions govern the relationship between the Vendor and Users (customers) who use our website. By clicking on an object, image, link (other than the terms and conditions) or button located on the www.hotfarm.eu website, you are deemed to have accepted or agreed to the terms and conditions described below. These General Terms&Conditions comply with the requirements of the Consumer Protection Act (CPA), as well as with other regulations in force in the Republic of Bulgaria. I. CONCEPTS AND DEFINITIONS
For the purposes of these Terms and Conditions, the following terms and expressions used herein shall have the following meanings:
"Vendor" is RODINOVI OOD, owner of the website and online store www.hotfarm.eu, which serves as a virtual platform for the presentation of our company and for the sale of our products. The Vendor has full rights to unilaterally change the content of the website as well as the ways of accessing it.
"User" is a person of legal capacity who has agreed to these Terms and Conditions of Use.
"E-shop" means the website www.hotfarm.eu , which serves as a virtual platform for the offer of goods for sale at a distance, which are delivered after their explicit request by the User.
"User Profile" is the part of the Site that contains information about the User. These data are provided by the User upon registration and are stored by www.hotfarm.eu. Access to the user profile is achieved by entering a username and password. In his profile, the User can view and edit the data entered at registration, access information about all his orders for the purchase of goods from the e-commerce store, change his password, etc.
"Password" is a combination of symbols (letters and/or numbers) chosen by the User, which together with the User's current e-mail address, individualizes the User and provides the User with the ability to place valid orders for the purchase of goods offered at www.hotfarm.eu.
"Online order" is the request made by the User to the e-shop for the purchase of one or more specific goods (items). The order is packed and sent by courier to the address previously specified in the order by the User.
"Selling price" means the final price per unit or per quantity of a good or service, including value added tax and any additional taxes and charges. The selling price does not include the shipping cost.
a "courier" is a merchant who physically delivers the purchased goods to an address specified by the Consumer and operates under the requirements of the Postal Services Act.
a "fortuitous event" is a circumstance of an extraordinary nature unforeseen at the time of the submission of the order which makes its execution objectively impossible.
"IP Address" ("IP Address") is a unique identification number that associates a computer, web page or resource with a User in a way that allows it to be located on the global Internet network.
"Brochure/Notice/Newsletter/Commercial Announcements" are electronic informational announcements relating to the activities of our company and the products manufactured during a certain period of time, which may be posted on the Website or may be sent by e-mail to a User if he/she has subscribed to receive the publication.
II. TERMS OF USE OF THE WEBSITE
2.1. Browsing the www.hotfarm.eu website is completely free, accessible and free of charge from anywhere in the world.
2.2. The vendor publishes at www.hotfarm.eu:
2.2.1. the selling price (all prices on the website are inclusive of VAT), the main features of the product and additional information aimed at helping you make an informed purchase choice.
2.2.2. information on the methods of payment, delivery and performance of the order. The cost of delivery is not included in the selling price. Information about these is provided at the completion of the order, as well as in the "Delivery and Payment" section.
2.2.4. the right of the User, the conditions and the manner of exercising it to cancel the order. The conditions under which the goods may be returned, except under the "Consumer Protection Act";
2.2.5. any other information that the vendor is obliged, under Bulgarian law, to provide to the User in a timely manner before the purchase of the goods by the User.
2.2. www.hotfarm.eu is a corporate website for the presentation of the Vendor and its activities, as well as an e-commerce website where all our products are available for purchase by end users. Users may use the information published on the site for personal, non-commercial use only. The content of the site may not be altered, copied, distributed, transferred or otherwise manipulated in any way.
2.3. Through the website www.hotfarm.eu you can make purchases through online orders. Every online order of a product is linked to a payment obligation by the payment method of your choice. Orders are accepted 24 hours a day, every day without a break. The processing and dispatch of orders takes place only on working days from 08:00 to 14:30. During the checkout process, you are able to view the products you are purchasing and their prices, your name, e-mail, phone number, address, zip code, shipping method and payment method. You will be notified by e-mail of any changes in the status of your order (confirmation, processing, dispatch, etc.). You can monitor the status of your current order as well as previous orders from your personal profile.
Ordering a product(s) through the online store implies consent to a distance sales contract, which is governed by the Consumer Protection Act.
Orders are only accepted through the online store. You can always contact our team at tel. 0899353828 to get information about our products, to make a claim or to check the status of an order already placed.
2.4. Registration is required to shop from the www.hotfarm.eu e-store. Registration is completely free and is done by filling in the registration form. When registering, the User must provide a current and valid e-mail and password, first and last name, shipping address, contact phone.
2.5. The User's registration data (first and last name, region, city, postal code, address for delivery of goods, mailing address, contact telephone number, current e-mail) is provided voluntarily and of their own free will when registering at www.hotfarm.eu. These data can be corrected at any time from the "Personal Profile" section They are protected by the Data Protection Act. User data is collected only to be transmitted to a courier and to make delivery of the selected goods.
2.6. Provider does not sell, rent, loan, trade, or give away any personal information collected on www.hotfarm.eu, including membership information or e-mail address lists. Any information given to www.hotfarm.eu will be kept secure and will not be used in any way for which the User has not consented.
2.7. The Vendor is entitled to change prices, quantities, payment and delivery methods, as well as the design and technology of the website. The Vendor has the right to suspend or delete information on a particular item or category at its discretion. The user should independently monitor the website www.hotfarm.bg for changes. In the event that a change is required in relation to an order already placed and the change affects the essential parameters of the order, such as price, product, delivery time, a representative of the Vendor shall contact the User to notify him of the change and to obtain information whether the User wishes to purchase the goods and under the changed conditions.
III. REGISTRATION. BROCHURE
3.1. By the act of registration, the User expresses "online" consent to these Terms and Conditions, and is thereby deemed to be bound by their provisions. From the moment of binding the User to the provisions of these Terms and Conditions offered through www.hotfarm.eu
3.2. By the act of registration and acceptance of these General Terms and Conditions, the User agrees to receive electronic correspondence, newsletter, messages regarding orders of goods and confirmations of changes to his data, as well as to receive advertising messages and information about promotions by e-mail, sms and any electronic means. The user may opt-out of receiving brochures and/or notifications to their email and mobile phone at any time by:
3.3.1. use the dedicated web link contained in each brochure and/or notice – the "Unsubscribe" button.
3.3.2. by contacting the Vendor at the email/telephone address indicated on the website with an explicit request not to receive brochures and/or notices.
3.4. If, after opting out of receiving brochures and/or notices, the User places an order, the User shall be deemed to have agreed to receive brochures and/or notices again.
3.5. The Vendor reserves the right to choose to whom to send brochures and/or notifications, as well as to remove from its database a User who has consented to receive brochures and/or notifications.
3.6. The Vendor shall include in the brochures and/or notices only advertising information relating to goods sold in the shop.
IV. COPYING INFORMATION
4.1. All information published on www.hotfarm is the property of the Vendor, including photographs and descriptions of items.
4.2. It is forbidden to copy texts from www.hotfarm.eu and paste them on other websites and online stores without written consent from the Vendor. Or cite the source by inserting the following text: "Source: www.hotfarm.eu", with the following link: www.hotfarm.eu
V. RESPONSIBILITY
5.1. The Vendor does not warrant that access to the Store will be uninterrupted, timely, secure or error-free to the extent that it is beyond its ability, control or will.
5.2. The Vendor shall not be liable for any damage caused to software, hardware or telecommunications facilities or for any loss of data resulting from materials or resources searched, loaded or used in any way through it.
5.3. Insofar as it does not have the objective possibility and obligation and does not control the Internet pages and resources made available through the electronic links placed in the store and in the user profile, the Vendor is not responsible for the illegal nature of the content and materials found on these Internet pages and resources.
5.4. The Provider shall not be liable for any damages or loss of profits resulting from the use, access or unreliability of these materials and content.
5.5. The Vendor, its suppliers or third parties shall not be liable under any circumstances for any damages, loss of information, loss of profit or otherwise caused as a result of the use or non-use of the site, this is regardless of the existence or non-existence of warnings against the Vendor. If the User's use of its materials results in damages requiring repair, service or correction of equipment or information, the User assumes all liability and all costs associated with repairing the damages.
5.6. The Vendor has no obligation and no objective possibility to control the way the User uses the website.
VI. REVERSE LINK
6.1. Any User can contact the Vendor to ask questions, make suggestions and receive information. Contact can be made at the e-mail address provided on the website, at the telephone number and via the contact form in the "Contact" section.
6.2. The provider is the administrator of the website and the comments and discussion area respectively. In fulfilling this function, it may remove any obscene or offensive qualification that violates morality and good manners.
VII. GENERAL PROVISIONS
7.1. The user can request the deletion of all data about him at any time.
7.2. The User shall indemnify the Vendor and all third parties for all damages suffered and benefits lost, including any costs and attorneys' fees paid, damages paid, legal costs incurred as a result of claims brought by third parties in connection with the User's failure to comply with its obligations, violation of Bulgarian law, applicable foreign laws, these Terms and Conditions, good morals and/or Internet ethics. The User is also obliged to indemnify the Vendor for any damage caused by third parties to whom he has provided his password when using the same.
7.3. The parties declare that in the event that individual parts of these Terms and Conditions are invalid, this shall not invalidate these Terms and Conditions and the individual invalid provisions shall be deemed to be superseded in law by mandatory rules of law.
7.4. All disputes between the parties shall be resolved in a spirit of understanding and goodwill. In the event that no agreement is reached, any unresolved disputes arising out of the relationship between the parties shall be settled by a court of competent jurisdiction in Varna or Sofia.
7.5. The written form shall be deemed to have been complied with by sending an e-mail, pressing an electronic button on a page with content to be filled in by the User or ticking a box on the Vendor's website and the like, as long as the statement is recorded technically in a way that allows it to be reproduced.
7.6. These Terms and Conditions may be unilaterally amended by the Vendor. Changes in the General Terms and Conditions do not affect the relationship between the User and the Vendor, which arose with a validly placed purchase order for goods before the notification. 7.7. The provisions of the legislation in force in the Republic of Bulgaria shall apply to the unsettled issues.
VIII. POSTING AND RATING REVIEWS
The posting of reviews (comments) on www.hotfarm.eu sites does not require the user to be registered unless explicitly stated. Registration is free. Users can also use Facebook and Instagram comments through their Facebook and Instagram registration.
In addition to posting, any user (including unregistered users) has the right to rate the opinions of other users.
8.1. Restrictions on the content of users' personal information
Users are not allowed in the comments, name, avatar, signature and all elements of their public profiles on www.hotfarm.eu:
8.1.1. impersonate other forum members by copying the name, avatar or signature of an existing user;
8.1.2. impersonate a specific public figure by using their name or picture on their profiles;
8.1.3. Use obscene or vulgar language, racial, sexual, ethnic, or religious slurs, calls for racial discrimination, ethnic or religious intolerance, sexual discrimination or violence, offensive descriptions of the physical, intellectual, or moral qualities of media representatives or specific public figures, spam, advertising content, pornographic content, or copyright-infringing content.
If the above conditions are violated, the moderators have the right to warn and subsequently deactivate the offenders' profiles, delete comments or not post them at all.
8.2. Site users have the right to:

9.1.1 In the case of a promotional campaign with a price reduction, a discount code cannot be used on an already reduced price.
